Ethical Risk Areas for Mediation

We all see it, and it is likely to have become so commonplace that it is no longer much of a surprise. What, you say? Every day another news article about ethics in or related to the law. While it is admittedly rare to see a news article about ethical dilemmas faced by mediators in daily practice, those, too, are more common than one would want to experience. Bearing in mind that mediators are left alone in resolving issues relating to ethical dilemmas raised as a result of acts of counsel vis a vis their clients or opponents in mediation, it is important to alert practitioners to some of these issues in light of the current ethical (or unethical) climate de jour.
