Dealing with Multi Party Complex Business Disputes

Litigation can be expensive, distracting and an inefficient way in which to resolve business disputes. This webinar will present techniques to resolve complex matters more efficiently and effectively through formal mediation before litigation.

By listening to this webinar you will learn these advanced techniques to maximize your chances of a mediated settlement of a multi-party, heavily technological business dispute while avoiding the expense and disruption of litigation altogether.

This dynamic webinar replicates the format of the November webinar by utilizing a detailed hypothetical (based on an actual case from the life sciences and healthcare arena) to highlight the principles of pre-litigation mediation in all types of complex business disputes.

Key messages will include the value of viewing mediation as a multiple phase process,particularly in the pre-litigation context: robust preparation with the multiple parties involved and the mediator, including detailed definition of possible claims, information sharing facilitated by the mediator (such as the exchange of documents and involvement of internal and possibly external experts on technical issues to substitute in part for extensive -- and often overly broad -- litigation discovery), tips on the best structuring of multiple party in-person session or sessions, and, if necessary, follow-up based upon a road map created as a result of the preparation and in-person meetings - including the use of limited expert determinations of arbitration to resolve thorny technological questions.
