This far-ranging discussion will include consideration of best practices in settlement conferences, making opening statements, preparation for mediation and settlement conferences, breaking impasse and effective tools for attorneys to use while advocating for their client in mediation and settlement conferences. The program will address the timing for settlement conferences and mediations and which procedure most effectively done first.  The panelists will discuss judicial discretion in regard to ADR, attorney frustration with effective and ineffective neutrals, and what the participants should do at the end of a mediation. The panelists include a sitting judge and former federal magistrate judge, practicing attorneys, and experienced neutrals.
