JAMS is the largest private alternative dispute resolution (“ADR” or “Services”) provider in the world, and we are committed to respecting your privacy rights and complying with all applicable privacy legislation. 1. When and How We Collect Personal Data About You

From the first moment you interact with us, we are collecting data. Here’s when and how we do this.

We collect your personal data when:

  • You use our Services as a participant in a JAMS arbitration, mediation or other ADR matter
  • You browse any page of our website
  • You fill out our Contact Us form
  • You sign up for Email Updates
  • You register for an account with JAMS Access – please see the JAMS Access Privacy Notice for more information
  • You engage with us for marketing activities, including when you receive emails from us or participate in marketing events and activities

You provide us with your personal data when:

2. The Types of Data We Collect

JAMS limits data collection to what is necessary to run our Site and deliver our Services.

For marketing activities, we collect your business contact information such as your name, organization, and work email, phone, mailing address, and membership and event registration information.

When your register and apply for a job with us through our Careers page, JAMS will collect your contact information including an email and password to register, and the professional and education experience provided in your resume. Please see our Candidate Privacy Notice for additional information. 

When you engage with JAMS Services, we may collect the following types of personal data with your active participation and consent:

  • Contact Information such as your name, position, company name, address, telephone/mobile phone
  • Preference Information such as for the hearing format, resolution center and Neutral, and other information about your case
  • Case information collected by JAMS, including personal data as necessary, relevant, and applicable to render Services

Does JAMS collect Sensitive Personal Data? 
We don’t collect sensitive data about you (like racial or ethnic origin, political opinions, religious/philosophical beliefs, trade union membership, genetic data, biometric data, health data, data about your sexual life or orientation, precise geolocation, and offences or alleged offences) except when we have your specific consent or when we have to in order to comply with the law. JAMS does not use or disclose your Sensitive Personal Data for the purpose of inferring characteristics.

Does JAMS collect children’s data? 
No. Our Site is not intended for use by children under 13 years of age, and we do not knowingly collect personal data, contact, or solicit information of any kind from children under 13. Information collected as part of our Services is not intended for use in contacting or soliciting information from children.

JAMS does not sell your personal data and does not use automated decision making and profiling.

Cookies

JAMS uses cookies or similar technologies to analyze trends, administer the Website, track visitors’ use of the Website, ensure a consistent and efficient experience, and perform essential functions such as allowing users to register and remain logged in.

3. How and Why We Use Your Data

Data protection law means that we can only use your data for certain reasons and where we have a legal basis to do so. Here are the reasons for which we process your data:

  • Delivering Services: Performing our contractual obligations to provide Services to you.

What does each legal basis mean?

Consent: You have given clear consent for you to process your personal data for a specific purpose. You can manage and choose to withdraw your consent at any time using the email unsubscribe link available in all marketing communications, by emailing us at info@jamsadr.info, or by contacting us through the phone or mailing address in the Contact Us section of this notice.

Contract: Processing your data is necessary for performing Services or because we have asked you to take specific steps before entering into that contract.

Legitimate Interests: Processing your data is in our legitimate interest, provided those interests are not outweighed by your rights and interests. These legitimate interests are:

  • Gaining insights from your behavior on our website and within our services sites
  • Delivering, developing, and improving JAMS services
  • Enabling us to enhance, customize or modify our services and communications
  • Determining whether marketing campaigns are effective
  • Enhancing data security

In each case, these legitimate interests are only valid if they are not outweighed by your rights and interests.


4. How We Share Your Data

Your data is shared only when strictly necessary, as required and managed by our contracts and policies, and according to the safeguards and good practices detailed in this Privacy Notice. We do not share your personal data with others except as indicated below or when we inform you and give you an opportunity to opt-out of having your personal data shared.

It is important to emphasize that JAMS never sells or shares your personal data, except through the use of website cookies, which you can control. 

We may disclose personal data that you provide as part of your participation in our Services to facilitate communication and interaction between you and JAMS, and between JAMS, parties to proceedings, Neutrals and JAMS Associates (i.e., employees).

We may share your personal data with authorized service providers that perform services on our behalf, which may include marketing, billing, data analysis, and technical support. Unless we tell you otherwise, our service providers may only use data we share with them in in accordance with our instructions - we do not permit our service providers to use any of your personal data for their own purposes or for promotional purposes.

We may disclose your data in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; in connection with a substantial corporate transaction, such as the possible sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy; or as otherwise required by law.

As noted above, you can manage your cookie preferences through the Cookie Consent portal or by activating your browser settings.

Removal from Marketing Email Communication - if you would like to opt-out of receiving marketing emails from JAMS, you may unsubscribe from receiving all marketing email communications by emailing us at info@jamsadr.info or clicking the Unsubscribe link at the bottom of all email. 6. How We Secure Your Data

Any personal data that you provide to us is stored on servers located in secure third-party data centers with restricted access, and which are protected by protocols, procedures and best practices designed to ensure the security of such information.

However, no server, computer or communications network or system, or data transmission over the Internet, can be guaranteed to be 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.

7. How We Store Your Data

The personal data we collect is processed at our offices in the United States and in any data processing facilities operated by authorized service providers. By submitting your personal data, you agree to this transfer, storing or processing by us. Where your information is transferred, we will take all steps reasonably necessary to ensure that your data is subject to appropriate safeguards, security, and data protections, and that it is treated securely and in accordance with this Privacy Notice.

8. How Long We Keep Your Data

JAMS will only retain your information for as long as necessary for the purposes set out in this Notice; as required to fulfill the terms of our contracts; as needed to provide Services to you; or to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements.

Please note that we are required to verify your identity before we are able to process any of the requests described in this Section; and at our discretion, deny your request if we are unable to verify your identity.

Candidate Privacy Notice

Effective October 18, 2023

This Candidate Privacy Notice (“Notice”) describes the types of personal information and sensitive personal information which JAMS (“Company”) may collect during the application and recruitment process, how we may use this information, with whom we may disclose this information, and how to access and update this information.

This Notice applies to the personal information and sensitive personal information about you that you or anyone else may provide (on your or the Company's behalf) to Company during the application and recruitment process (“Candidate Data”) including through our job site and recruitment platforms.

Types of Candidate Data We Collect

The types of Candidate Data that you share with us and/or that we may obtain from third parties, such as your former employers, references, employment screening agencies, recruiters, and recruiting and other websites, include: 

  • Name, address, email address, telephone number, and other contact information;
  • Resume, CV, cover letter, previous work experience, professional licenses and certifications, job skills and qualifications, and education information;
  • Online questionnaire results and information from interviews; and
  • Any additional information provided or revealed during the application and recruitment process (e.g., language preference). 

During the application JAMS collects information, such as nationality, race, disability, veteran status, social security number, birthdate, gender or ethnic origin voluntarily submitted by candidates as permitted or required by local, state, or federal law or regulation.

Use of Candidate Data

JAMS may collect, use, and otherwise process your Candidate Data for human resources and business management purposes, including: 

  • to evaluate your skills and qualifications for Company positions;
  • to communicate with you;
  • to maintain appropriate record-keeping related to recruitment and hiring practices and processes;
  • to verify your information and conduct reference and background investigation checks, where permitted. 

JAMS also may collect, use, and otherwise process your Candidate Data to comply with applicable laws, regulations, legal processes, or governmental requests. 

JAMS does not sell your Candidate Data. JAMS also does not share your Candidate Data with a third party for cross-context behavioral advertising.

You are under no obligation to provide Candidate Data to JAMS during the recruitment process. However, if you do not provide the information, we may not be able to process your application properly or at all.

Retention of Candidate Data

If you are hired, your Candidate Data will be transferred to an employee personnel file and used and retained for as long as necessary in connection with your employment for Human Resources and business management purposes in accordance with applicable law. 

If you are not hired, JAMS may retain and use your Candidate Data for a further fixed period in order to consider you for other job opportunities or as otherwise required by law. Please note that some information may be retained as necessary to comply with our legal obligations.

Disclosure of Candidate Data

JAMS may disclose your Candidate Data internally and with service providers and other third parties that have been engaged to perform recruitment and employment-related services on behalf of the Company. These third parties are required to use appropriate measures to protect the confidentiality and security of your Candidate Data. 

The Company may also be required to disclose certain Candidate Data to third parties as required by law or regulation or in response to legal process or lawful requests by public authorities, including to meet national security or law enforcement requirements.

JAMS is committed to using appropriate technical and organizational measures designed to protect the security and confidentiality of your Candidate Data.

Your Rights

Under certain privacy and data protection laws, you have the following rights:

  • Right to Know & Access what Candidate Data JAMS has collected about you, including the categories of Candidate Data, the categories of sources from which the Candidate Data is collected, the business or commercial purpose for collecting Candidate Data, the categories of third parties to whom JAMS discloses Candidate Data, and the specific pieces of Candidate Data JAMS has collected about you.
  • Right to Delete your Candidate Data, subject to certain exceptions.
  • Right to Correct inaccurate Candidate Data that JAMS maintains about you.
  • Right to Restrict JAMS use of your Candidate Data.
  • Right to Data Portability of your personal data in a structured, commonly used, and machine-readable format.
  • Right to Non-Discrimination against you for exercising any of your rights. 

JAMS does not Sell or Share your personal data; does not use automated decision making and profiling; and does not use or disclosure your Sensitive Personal Information for the purpose of inferring characteristics.

Changes to this Notice

We will update this Notice from time to time. We will post the revised Notice with an updated revision date on the Company corporate site and link to it from our jobs site and recruitment platform. If we make any material changes, we will provide notice through these sites or by other means.

JAMS Data Processing Addendum

This Data Processing Addendum (the “Addendum” or “DPA”), reflects the requirements of the California Consumer Privacy Act (“CCPA”), as amended and is incorporated into and forms a part of the master agreement, purchase order, or other terms (the “Agreement”) under which JAMS provides Services to Clients (; collectively the “Parties.”)

Capitalized terms identified in this Addendum shall have the same meaning as defined in the CCPA, unless otherwise noted.

This Addendum applies to the collection, retention, use, and disclosure (“Processing”) of Personal Information to provide Services.

The Parties agree as follows:

  • JAMS understands its obligations under the CCPA/CPRA and will comply with them, providing the same level of privacy protections required under the law.
  • JAMS will notify Clients if it makes a determination that it can no longer meet its obligations under the CCPA/CPRA.
  • For avoidance of doubt, JAMS is a Service Provider as described in the CCPA/CPRA.

Therefore, JAMS shall not:

  • Sell the Personal Information Processed on Clients’ behalf.
  • Retain, use, or disclose the Personal Information for any purpose other than providing the Services specified in the Terms.
  • Retain, use, or disclose the Personal Information outside of the direct business relationship and specifically shall not:
    • Combine Personal Information across customers.
    • Have, derive, or exercise any rights or benefits regarding Personal Information Processed on Clients’ behalf.
  • Engage or outsource Personal Information Processing to any Sub-processors without entering into a written agreement containing appropriate safeguards to the protection of Personal Information with each Sub-processor.

Therefore, JAMS shall:

  • Implement and maintain appropriate technical and organizational measures to protect Personal Information against security incidents and preserve the security and confidentiality of Personal Information.
  • Ensure access to Personal Information is limited only to employees who directly provide services to Clients, and that those employees are subject to an appropriate means of confidentiality.
  • Notify Clients about any possible Personal Information Data Breach without undue delay and take reasonable steps to minimize harm and secure Personal Information.
  • Provide reasonable assistance in responding to Consumer Rights Requests.
  • Delete or return, as permitted by law, all Personal Information Processed under this DPA upon termination of the Terms.

Notwithstanding anything in the Terms or other document, the Parties acknowledge and agree that JAMS’ provision of access to Personal Information is not part of and is explicitly excluded from the exchange of consideration, or any other thing of value, between the Parties, and is not provided for purposes of cross-context behavioral advertising.

The provisions of this DPA shall apply as long as JAMS Processes Personal Information for Clients.






Your Rights under the General Data Protection Regulation (GDPR)

In addition to the specific information about our data collection and processing practices posted in the JAMS Privacy Notice, to JAMS (“JAMS,” “we,” “us” or “our”) wants you to understand your rights and choices under the General Data Protection Regulation (GDPR) regarding how we may process your personal information.

Please note that we are required to verify your identity before we are able to process any of the requests described in this Section; and at our discretion, deny your request if we are unable to verify your identity.

Under the GDPR:

You have the right to access information we hold about you: This includes the right to ask us supplementary information about:

  • the categories of data we’re processing
  • the purposes of data processing
  • the categories of third parties to whom the data may be disclosed
  • how long the data will be stored (or the criteria used to determine that period)
  • your other rights regarding our use of your data

The Right to Erasure/Deletion: You have the right to ask us to erase your personal information in certain circumstances.

The Right to Rectification/Correction: You have the right to ask us to correct information you think is inaccurate, and to ask us to complete information you think is incomplete.

The Right to Data Portability: You have the right to ask that we transfer the information you gave us to another organization, or to you, in certain circumstances.

The Right to Restrict Processing: You have the right to ask us to restrict the processing of your information in certain circumstances.

The Right to Object to Processing: You have the right to object to the processing of your personal data in certain circumstances.

The Right to Lodge a Complaint: You can file a complaint regarding our use of your data directly with JAMS by emailing us at info@jamsard.info, through our mailing address in the Contact Us section, or by contacting EDPO, our UK and EU representatives (information below).
