Beyond Brook B: Litigating Same Sex Parenting Cases in the New Legal Landscape

The speakers will be exploring the legal landscape with the demise of the Bright Line rule enunciated in Alison D. Specifically, the speakers will discuss different ways to establish the pre-conception agreement and what other standards may be available for parents. In addition, the speakers will propose protocols for the re-introduction of the parent who has been barred access to their child. Lastly, the speakers will discuss the emergence of children’s rights—separate and apart from those of the parents—and how the Court of Appeals recognized those rights in the Brooke B. decision.
